Phase 2 of IEEPA refunds open
Phase 2 of the Consolidated Administration and Processing of Entries (CAPE) IEEPA tariff refunds claim system is open for certain entries flagged for reconciliation, including entry types 01, 02 and 06, when importers have not filed a reconciliation entry. Only unliquidated entries within 80 days of liquidation are eligible. Phase 2 operates concurrent with Phase 1, which covers certain unliquidated entries and entries within 80 days of liquidation. Importers should review entry eligibility, confirm ACE Portal banking information and monitor future CAPE phases for entries not yet covered. USMCA negotiations underway
The U.S. and Mexico reported substantive progress after the second round of bilateral discussions ahead of the July 1 formal review of the U.S. – Mexico – Canada Agreement (USMCA). According to the U.S. Trade Representation (USTR), discussions focused on economic security, rules of origin for key industrial goods (particularly automotive manufacturing), agricultural trade modernization and establishing a level playing field. NAFEM is part of a coalition of 500 U.S. businesses communicating support for the USMCA to USTR Ambassador Greer.
Section 301 tariff appeals exhausted
The U.S. Supreme Court declined to hear a challenge to the Section 301 tariffs, exhausting all appeals and leaving the tariffs in place. The decision clears the way for dismissal of more than 3,500 cases filed before the U.S. Court of International Trade alleging the tariffs exceeded the government’s authority.
